Jerry Active Indicted for Mountain View Home Invasion

On June 3, 2013, 24 year old Jerry Andrew Active was indicted for the murders of two grandparents who were babysitting their granddaughter on May 25, 2013. Active was also indicted for committing multiple sexual assaults and sexually abusing a minor as well as committing burglary during the same incident. Active was also charged with misdemeanor assaults for the injuries he caused to the parents of the minor child.

Active was indicted on ten felony counts in total. The indictment is a charging document and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the State must prove guilt beyond a reasonable doubt as to each charge.

If convicted of all of the offenses, Active faces a minimum sentence of 171 years in prison and a maximum sentence of 616 years in prison and a fine of $500,000. If convicted of the charges, Active also faces lifetime registration as a sex offender. If convicted, Active’s sentence would be determined by a judge, who is required to consider the seriousness of the crimes and the offender’s criminal history.
