About the Torts & Workers' Compensation Section
The Torts and Workers’ Compensation Section is at the forefront of defending the State of Alaska in a wide array of civil litigation and employment-related matters. This section is composed of two highly collaborative work groups—Torts and Workers’ Compensation—each handling legally complex and impactful cases that help shape the state’s legal landscape.
Torts Work Group
The Torts Work Group provides legal defense in civil lawsuits filed against the State, its agencies, and employees. These cases often involve:
- Personal injury claims, such as those arising from motor vehicle accidents involving state vehicles, injuries on state property, or alleged negligence by state employees
- Property damage claims, including disputes over flooding, fire, or construction-related damage allegedly caused by state operations
- Civil rights lawsuits, such as claims of excessive force, wrongful arrest, or violations of due process and equal protection under the law
Attorneys in this group also provide proactive legal advice and training to state agencies to help reduce liability exposure and improve risk management practices. The work is fast-paced and litigation-intensive, offering opportunities to engage in pretrial motions, discovery, jury trials, and appellate advocacy in both state and federal courts.
Workers’ Compensation Work Group
The Workers’ Compensation Work Group represents state agencies in cases involving workplace injuries and occupational illnesses affecting state employees. These cases require a deep understanding of Alaska’s workers’ compensation laws and often involve:
- Claims for medical treatment and wage loss benefits
- Disputes over causation, pre-existing conditions, or permanent impairment
- Complex cases involving mental health claims, repetitive stress injuries, or long-term disability
Attorneys in this group also provide legal counsel to the Department of Corrections and the Division of Risk Management, helping agencies navigate the legal and procedural aspects of workplace injury claims.
